MP names Giggs in debate on super injunctions

Liberal Democrat MP John Hemming today named Ryan Giggs in a parliamentary urgent question on super injunctions.

He said:

“With about 75,000 people already having named Ryan Giggs on Twitter, it’s obviously impracticable to imprison them all, and with reports that Giles Coren also faces imprisonment…”

He was then cut short by the Speaker.

Attorney General Dominic Grieve replied:

“It is our duty as parliamentarians to maintain the rule of law.”

    This is an interesting one.

    I am in favour of parliamentary privilage, but I think this time he abused it.

    Interestingly, I read in the Guardian this morning that the Herald could possibly face trouble because, under case law established in the 1987 Spycatcher case, if someone publishes information subject to an injunction they are aware of, but not served with, they may be in breach of the spirit of the injunction and therefore in Contempt of Court.
    “In that case, the House of Lords suggested that the interdicts were wider-reaching: the Lords intimated that if you were aware of the injunction, even if you were not served with it, it would be against the spirit of an injunction to publish any information contravening it and that doing so would be a contempt of court.”
